This is an appeal about a proposed off street car parking space in a front garden in a Conservation area. The Inspector took into consideration the effect on the Conservation area and on the living conditions of the occupants of the flat overlooking the proposed space. Policies B13 and B15 and the SPG 'Off street parking in Conservation Areas' were relevant, as well as B2.

H7 Housing mix aim was compromised as the surrounding area had 55.6% small flats or apartments in 2001 census. Now more.Also the amenity of future residents by overdevelopment of the site would be unacceptable under H7.

Main Issues2.
I consider the main issues in this appeal to be, having regard to planning policy:
(a) The loss of community land;
(b) The effect of the proposal on the character and appearance of the area;
(c) The impact on road safety; and,
(d) Provision for recreational facilities and open space.

The proposal involves a loss of community land without any compensatory facility, in a locality with a demonstrable need for such resources, in conflict with the development plan.
The Inspector refers to conflict with policies CS1, B1,2,5 and 8 in his decision.
He does not accept impact on road safety contrary to policy M1.
He questions the validity of SPD 4 Planning Obligations formula for developer contribution towards Parks and Green Spaces.

Main issues3.
There are two main issues in this appeal. The first is the effect of the proposedbuildings upon the character and appearance of the site and the area aroundthe junction of Whitehall Road with Whitehall Avenue. The second main issueis the effect of the proposed pair of semi-detached dwellings on the livingconditions of neighbouring occupiers at 446 Whitehall Road, with respect toovershadowing.

The Inspector considers that the proposed development would not comply with aims or requirements of policies B1, B2, B5,B6 and B8 and Planning Policy Statement 3 “Housing”.He does not consider that the proposed development would cause overshadowing or would have a harmful impact upon the living conditions of the neighbouring occupiers.

This is an application to change the use of a shop on Fishponds Road to a Takeaway. The Inspector considered S8 which states that no development would be allowed which would harm the amenity of nearby residents with regard to parking or highway servicing problems.

The main issues are:
i) the effect of the proposal on the character and appearance of the CliftonConservation Area, and
ii) the implications of the proposal for highway safety.

The Inspector considered policies B1,2,6 and 13 and PPG 15, Planning and the Historic Environment for this appeal. He decided that Highway Safety would not be harmed nor would there be a breach of M1 but that the character and appearance of the area would be harmed.

The Inspector concluded that the proposed change of use would be unacceptably harmful to the vitality and viability of the local shopping parade contrary to S7 and PPS 6, 'Planning for Town Centres'.

The Inspector considered that this overlarge extension would cause unacceptable harm to the amenities of neighbouring occupiers.
He refers to the 'Be a Good Neighbour' section of 'A Guide for Designing House Alterations and Extensions' published by the council as an SPD which he regards of significant weight although the appeal property is not a house. Policy B1, 2 and 9 are also relevant.
